  Edmund Lewis, Botswana

Is Ombudsman and Public Protector not one and the same thing? are we seeing a duplication of titles or is there any major difference one can draw between the two?

  NDBS Answer:

Ombudsman is an official appointed to investigate individuals' complaints against maladministration, esp. that of public authorities and big corporations. Ombudsman mediate settlements and the services of ombudsman are free, on the other hand The Public Protector plays the similar role but strictly confined to any matter reported by citizens in group or individuals.  The matter can be against the President of the country or civil servant.  Public Protector’s recommendations and findings may lead to prosecution of the one found to have broken the law and is widely practiced in Countries such as South Africa.

When Can One Issue Cease and Desist Order In Business?

I just want to understand how this cease and desist order works especially within business world. And Who can it be directed between individual and company.

Posted: September 16 2013

  NDBS Answer:

This can be issued if one feels their business or individual status is compromised.  This is a formal request directed to individual or company to stop certain activities that may compromise the brand, proprietary rights of the company or individual issuing the order.  In business this happens where one company use the information or name of another company, an order can be issued to stop such behavior and failure to do so may lead to litigation.
